TERMS & CONDITIONS OF USE

- Terms of Use
1.1 The MyIrishLife mobile app (the “App”) is provided to you jointly by Irish Life Assurance plc (ILA), Irish Life Health DAC (ILH) and Irish Life Financial Services Ltd (ILFS) collectively referred to as Irish Life.
1.2 When we refer to “we”, “us”, “our” we mean ILA, ILH and ILFS collectively. Our registered offices are at Irish Life Centre, Lower Abbey Street, Dublin 1.
1.3 These Terms of Use (as amended from time to time, the “Terms”) govern users (“Users”, “you” or “your”) access to, downloading of and use of the App.
1.4 The App support team can be contacted by webchat (available through the App) or by emailing myirishlifesupport@irishlife.ie. 1.5 The App is being provided in order to allow currently registered Irish Life customers to view or administer their health, pension, life or investment policies that they currently hold with Irish Life.
1.6 Users should only access, download and use the App if you are (i) aged 18 years or older (ii) live in the Republic of Ireland, (iii) are legally permitted to enter into binding agreements and (iv) are an existing Irish Life customer. The App is to be used uniquely by one customer only and cannot be used jointly (even where there are a number of customers on any policy). Each customer should access the App through a separate login.
1.7 These Terms of Use are important and are for the protection of both Users and Irish Life. Please take the time to read the Terms of Use carefully.
2. Downloading the App
2.1 Your access to, downloading of and use of the App is subject to your acceptance of and compliance with these Terms and where you download the App, the App Store rules referred to in these Terms will apply. Each time you download, access or use the App (including any updates), you agree to the then current version of these Terms and, if applicable, relevant App Store rules. If you do not agree to the current version of these Terms or, if applicable, App Store rules, you are not permitted to continue accessing or using the App and must remove the App from your device.
2.2 You may download, access and use the App solely for your personal and non-commercial use. This is the only right and licence granted to you under these Terms.
2.3 You can download and use the App (including updates to it) using compatible devices authorised by the relevant App Stores only. It is possible that, depending on your device, some features of the App may not be compatible. You must own or control the devices you use in order to download and use the App. You are responsible for installing App updates. If you don’t do so, this may impact App functionality and security and your ability to use it.
2.4 If you download our App from a third-party app store (the "App Store"), you acknowledge and agree that:
2.4.1 the Terms are an agreement between us and you, and not between you and the App Store. As between Irish Life and the App Store, Irish Life is solely responsible for the App;
2.4.2 the App Store has no obligation to provide any maintenance and support services with respect to the App;
2.4.3 in the event of any failure of the App to conform to any applicable warranty, (i) you may notify the App Store and the App Store may refund the purchase price for the app to you (if applicable), (ii) to the maximum extent permitted by applicable law, the App Store will have no other warranty obligation whatsoever with respect to the app, and (iii) any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be, as between Irish Life and the App Store, Irish Life’s responsibility;
2.4.4 the App Store is not responsible for addressing any claims you have relating to the App or your possession and use of the App;
2.4.5 if a third party claims the App infringes another party's intellectual property rights, as between the App Store and Irish Life, Irish Life will be responsible for the investigation, defence, settlement and discharge of any such claim to the extent required by these Terms;
2.4.6 the App Store and its subsidiaries are third-party beneficiaries of these Terms as it relates to your license to the App. Upon your acceptance of these Terms, the App Store will have the right (and will be deemed to have accepted the right) to enforce these Terms as related to your license of the App against you as a third-party beneficiary;
2.4.7 you represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
2.5 App Store Rules: If you downloaded or access the App through the Apple Inc. (Apple Inc. together with all of its affiliates, “Apple”) app store, if any of these Terms are inconsistent or in conflict with Apple’s applicable instructions for Minimum Terms for Developer’s End User License Agreement (located at http://www.apple.com/legal/internet-services/itunes/appstore/dev/minterms/ (the “Apple EULA Terms”)) or the App Store Terms and Conditions (located at http://www.apple.com/legal/internet-services/itunes/ca/terms.html (the “Apple App Store Terms”)) the terms and conditions of the Apple EULA Terms or Apple App Store Terms, as applicable, will apply to the extent of such inconsistency or conflict.
2.6 Google Play Store Rules: If you downloaded or access the App through the Google Inc. (Google Inc. together with all of its affiliates, “Google”) app store, if any of these Terms are inconsistent or in conflict with Google’s Google Play Developer Distribution Agreement (located at https://play.google.com/about/developer-distribution-agreement.html (the “Google EULA Terms”)), the terms and conditions of Google EULA Terms will apply to the extent of such inconsistency or conflict.
3. Personal Data and Using the App
3.1 By accessing and using the App, the User acknowledges that their personal data will be processed by Irish Life. Limited personal data including your contact details, the name of the plans you hold and sign on details are shared between ILA, ILH and ILFS for the purposes of verifying your identity and providing you with the initial dashboard view of your plans in MyIrishLife.
3.2 When you login to MyIrishLife, you will have control over certain personal data preferences, such preferences include your consent for direct marketing and where applicable, your consent to the display of additional information such as plan values. 3.3 Biometric Data. This App (available on iOS and Android) supports using biometrics to login. You can elect to use Biometrics if they are supported and configured on your device. Note that Irish Life does not process, store or have any access to biometric data – the device will simply confirm your identity to the App, when you open the App. You can enable and disable this within the App’s settings and also within the device settings.
3.4 Your login and transaction activities on the App are also recorded on our systems.
3.5 Monitoring App performance. We use Firebase to monitor App performance and report any crashes. All the data available is at aggregate level only and individuals are not identifiable.
3.6 Push Notifications. The App can send push notifications. You can opt in and out of receiving push notifications at any time by updating the App settings on your device. If you opt in to receive push notifications, we need to collect your device ID to provide this service. This data will be collected by ILH, ILA and ILFS jointly.
4. Operations and Accounts
4.1 You must hold a registration for the MyIrishLife web portal in order to access the App. The username and password registered for the MyIrishLife website are required to register and create an account to use the App.
4.2 You are responsible for safeguarding the login details that you use to access your account and for any actions taken by anyone accessing your account where you have provided them with your login details or being reckless with your account security. For data security purposes, Irish Life strongly recommends that you use “strong” passwords (i.e. passwords combining upper- and lower-case letters, numbers and symbols).
4.3 If you change your email address or forget your password, please notify us either through the Password and Sharing Options section of the App settings or by email at myirishlifesupport@irishlife.ie in order to recover your account. Please note that we can only reply to the email address that you used to register your account.
4.4 We may change (including by removing features and benefits), cease or suspend the form, nature, features and benefits of the App from time to time without prior notice to you.
5. How you may use the App
5.1 By using the App you undertake that, to the best of your knowledge and belief, all information provided to Irish Life is true and complete. Where you supply information relating to another person, you confirm that you have obtained consent from that person to use their personal information and share such information with Irish Life. Failure to comply with these requirements may result in your policy being withdrawn and/or legal action being taken against you.
5.2 There are some online tools available to use through the App. When you are using these online tools, you authorise Irish Life to act upon the instructions you provide through such online tools without taking any further steps to authenticate such instructions.
5.3 Webchat is provided to all Users to receive assistance in relation to the navigation and use of the App. Use for any other purpose is prohibited. Webchat is not provided for the purpose of assisting you in the selection of purchasing any of our policies. By using Webchat the User acknowledges that the administrators of Webchat will process personal information disclosed during the course of the chat including logging necessary browser information. No warranty is given by us as to the availability of the Webchat service.
5.4 Irish Life reserves the right to take the following actions in particular for failure to comply with these Terms:
5.4.1 immediate, temporary or permanent withdrawal of your right to use the App;
5.4.2 issue of a warning to you; and/or
5.4.3 issuing of legal proceedings against you for reimbursement of all costs, losses and damages we and our affiliates suffer on a full indemnity basis.
6. Intellectual Property Rights
6.1 Irish Life is the owner or licensee of all intellectual property rights in or on the App, including text, graphics, user interfaces, visual interfaces, illustrations, photographs, trademarks, logos and computer code, the design, structure, arrangement, selection, coordination, expression, and 'look and feel' of the App (together, “Irish Life Content”). All of these rights are protected by copyright and other intellectual property laws and treaties around the world. All rights are reserved to the relevant owner or licensee of those works. The User's use of the App and Irish Life Content does not grant the User any rights in relation to any of the intellectual property rights or other associated rights.
6.2 The User may not alter, reproduce, republish, sell, disseminate, distribute, transmit, broadcast, reverse engineer or commercially exploit Irish Life Content or the design or look and feel of the App, unless the User has received Irish Life's prior written consent. The User may not store, link, frame, scrape, or deep-link Irish Life Content or the App on any other website or app or in any other medium or format without our prior written consent.
6.3 Irish Life reserves the right to investigate any suspected or actual improper, illegal, or unauthorised use of Irish Life Content or the App (or any part of them) and Irish Life reserves the right to take appropriate legal action.
7. Apps and Websites we link to
7.1 Irish Life is not responsible or liable for the availability or accuracy of any third-party apps or websites to which we provide links or the content, products, materials, or services on or available from such third-party apps or links. Any links do not imply or mean an endorsement by Irish Life. The User is solely responsible, and assume all risk, from use of any apps or websites to which Irish Life links.
7.2 The App contains hypertext links to websites maintained by members of Irish Life Group. The User acknowledges and agrees that different terms and conditions of use may apply to them as a user of such websites.
8. Disclaimers
8.1 Any Information transmitted via the App passes over public telecommunications networks. Although Irish Life uses industry standard encryption technology, like other companies that operate online, we cannot and do not guarantee that the operation of the App will be 100% secure, uninterrupted or error free.
8.2 Irish Life will make all reasonable attempts to exclude viruses from the App but cannot guarantee that such attempts will be successful. The User should, therefore, take such steps in respect of any such risk as are appropriate to it.
9. Limitation and Exclusion of Liability and Indemnity
9.1 Nothing in these Terms of Use excludes or limits Irish Life's liability for fraudulent misrepresentation or for death or personal injury resulting from Irish Life's negligence or any other liability, the limitation or restriction of which is prohibited by law.
9.2 Irish Life supplies and makes available the App for domestic and private use only. Irish Life is not liable to the User for any loss of profit, damage to reputation, loss of business, business interruption or loss of business opportunity arising from or in connection with the use of the App.
9.3 Irish Life cannot guarantee that third parties will comply with our Terms of Use. Irish Life has no liability or responsibility in respect of content on the App created by someone other than us or posted by a third party or the acts of any third party, even if we have monitored, edited, moved, deleted, or reviewed it or it breaches our Terms of Use.
9.4 The information, materials and links provided on the App, or accessible through the App, are made available "as is" and "as available" without any representations or warranties of any kind. Irish Life disclaims all warranties or representations, express or implied, regarding the App and all information, materials and links provided on, or accessible through the App, including without limitation, the accuracy, relevance, timeliness, completeness or appropriateness of the contents of the App.
9.5 As a consumer, the User will have certain rights under statute that cannot be excluded by contract. These Terms do not limit or affect any of those rights that cannot be excluded by contract.
9.6 You agree to indemnify and hold harmless and keep Irish Life at all times fully indemnified from and against all actions, proceedings, claims, demands, costs (including, without limitation, reasonable legal costs), liabilities, awards and damages howsoever arising directly or indirectly out of, in connection with or relating to any breach by you of any of provision of these Terms.

11. General
11.1 In the event that any provision of these Terms is held to be invalid or unenforceable, the remaining provisions of these Terms shall remain in full force and effect.
11.2 Any failure by us to exercise or any delay by us in exercising a right or remedy does not constitute a waiver of that right or remedy or of any other rights or remedies. A waiver by us of any breach of, or any default under, any provision of the Terms is not a general waiver or a waiver of any subsequent default or breach and in no way affects the other terms of the Terms.
11.3 We may transfer our rights and obligations under these Terms to another organisation. We will always inform you if this happens and we will ensure that the transfer will not affect your rights under these Terms. If you are unhappy with the transfer, you may cancel your account in accordance with these Terms.
11.4 You cannot transfer your contract with us under these Terms or account to any other person.
11.5 You undertake to access the App solely in compliance with these Terms and all applicable rules and regulations. If you choose to access the App from outside the Republic of Ireland, you are solely responsible for compliance with any applicable local laws.
11.6 The existence, formation, interpretation, operation of these terms and conditions, and all matters and disputes (whether contractual or non-contractual) arising out of or in connection with these Terms or their subject matter, is subject to Irish law and you can bring proceedings in respect of these Terms in the Irish courts.
11.7 We may revise these Terms from time to time. The most current version will be available on the App. The revised Terms shall become effective from the date of publication on the App. We will normally give you notice of any change by sending you either an SMS, email or push notification with details of the change or notifying you of a change when you next use the App. If you do not accept the notified changes you should stop using the App and remove it from your device.
